Delhi : The Supreme Court, on Monday, directed ICAI (Institute of Chartered Accountants of India) to extend the opt-out option and changing the exams pattern. The Apex court stressed that the ICAI should be flexible with the’opt-out’ scheme for the CA examination to be held between July 29 and August 16, considering the coronavirus pandemic situation.
The honourable Supreme Court has asked ICAI to follow MHA guidelines for conducting the CA exams 2020 .The matter will be next considered by the bench on July 2.
Apex bench comprising Justices AN Khanwikar, Dinesh Maheshwari and Sanjiv Khanna was hearing the petition filed by the India Wide Parents Association challenging the ‘opt-out scheme’ , and seeking more centers for ICAI CA exams 2020. The petitioner through advocate Alok Srivastavan , submitted that the ICAI announced it will conduct the May 2020 cycle CA exam between July 29 & August 16.
The SC told to ICAI “The situation is continuously changing. Even if a candidate has not chosen opt-out option if they suddenly come under a containment zone what will you do ? You should treat candidates who don’t appear as opt-out cases”
Meanwhile , On July 15, The ICAI notified that the students can avail an ‘opt-out’ option, as per which their attempt will be treated as cancelled, and will be carried forward to the exams scheduled in November. The deadline for ‘opt-out’ option is June 30.
The three justices apex bench said that the situation due to Covid-19 pandemic was not “static” and was “dynamic” . So, the option for opt-out must kept open till last exam.
